Florida lawmakers are discussing a bill that would essentially allow the police to demand blood tests in which they suspect misdemeanor DUI. The argument is that the bill would keep more offenders off of the road, but it is unclear that there is any evidence to back up that claim.
Opponents of the bill have pointed out that the bill would not actually create any additional arrests, but rather just create more blood tests to be done by FDLE. Additionally there is the concern of the individual’s privacy rights. A blood test is a rather invasive form of government intrusion into the lives of an individual who is supposedly innocent until proven guilty.
Additionally, there has essentially been no plan on how to implement the bill. The sponsor of the bill could not answer basic questions of implementation before the committee, such as what medical professionals would be available for tests to be performed.
The measure has been temporarily tabled for the time being, as its sponsor seeks additional support, and hopefully permanently so.
Driving under the influence is serious and can lead to even more serious consequences. But as a society we have to ask ourselves if we want to allow such an invasive test, when we already have breathalyzers.
