Gov. Scott Signs Stand Your Ground Bill – Marion County Criminal Lawyer Hernando County Criminal Lawyer Ocala
Governor Rick Scott has signed Senate Bill 128 into law. The bill shifts the burden of proof in Stand Your Ground cases from the Defendant to the Prosecution. Under the old law, The Florida Supreme Court placed the burden of proof on the Defendant in order to avoid prosecution, and this law reverses that.
Critics are worried that this law will essentially allow people to get away with murder and avoid prosecution in questionable situations. Proponents of the bill believe that this law gives the shooter the presumptions of innocence, in line with the idea of “innocent until proven guilty.”
The fact of the matter is that stand your ground cases, or any case where whether or not excessive force was used is a difficult balancing act and a tough evaluation. Stand your ground has provided plenty of controversy and now the burden shift makes it a little easier to use as a defense.
